3. Subscriptions and Account Registration

3.1 Free Subscriptions

Water Daily offers free email newsletter subscriptions. By subscribing, you provide your email address and consent to receive our newsletters and related communications. You may unsubscribe at any time using the unsubscribe link included in every email.

3.2 Account Information

You agree to provide accurate, current, and complete information when registering or subscribing. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 Subscriber Eligibility

The Services are intended for professionals and organizations operating in or serving the water and wastewater industry. We reserve the right to verify subscriber credentials and to decline or cancel subscriptions at our sole discretion.

4. Intellectual Property

All content on the Site, including but not limited to articles, graphics, logos, photographs, audio clips, digital downloads, data compilations, and software, is the property of Encore360, LLC or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws.

4.2 Permitted Use

You may access and use content on the Site for your own personal, non-commercial, informational purposes. You may share brief excerpts of content with appropriate attribution to Water Daily and a link to the original article.

4.3 Prohibited Use

Without our prior written consent, you may not:

Our total liability to you for any claim arising from or related to these Terms or your use of the Services will not exceed fifty dollars ($50.00).

Any dispute arising under or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Cuyahoga County, Ohio.

We reserve the right to terminate or suspend your access to the Site or Services at any time, with or without cause, and with or without notice. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.

16. Miscellaneous

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions. The failure of Encore360, LLC to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Encore360, LLC with respect to your use of the Site and Services, and supersede all prior or contemporaneous understandings regarding such subject matter.
